Evil Genius MindWorks provides analytics modernization, AI readiness consulting, data engineering, Qlik consulting, and related professional services to enterprise organizations. The Site provides information about our services and products (including Cloud View Pro), interactive tools (including the R.O.T. Cost Calculator and Diagnostic questionnaire), educational resources and downloadable guides, case studies, blog content, and the ability to contact us or schedule discovery calls.

The Site is intended for use by business professionals and organizations. By using the Site, you represent that you are at least 18 years of age and have the authority to agree to these Terms on behalf of yourself or the organization you represent.

Permitted Use. You may use the Site for its intended purposes: learning about our services, using our interactive tools, accessing educational resources and downloadable guides, contacting us, and scheduling consultations.

Prohibited Conduct. You agree not to: use the Site for any unlawful purpose or in violation of any applicable law or regulation; attempt to gain unauthorized access to the Site, its servers, or any systems or networks connected to the Site; interfere with or disrupt the operation of the Site, including through the introduction of viruses, malware, or other harmful code; scrape, crawl, or use automated tools to extract content or data from the Site without our prior written consent; reproduce, distribute, modify, or create derivative works from any content on the Site except as expressly permitted; impersonate any person or entity, or misrepresent your affiliation with any person or entity; submit false, misleading, or fraudulent information through our contact forms, resource download gates, scheduling tools, or interactive tools; use the Site to send unsolicited communications, spam, or commercial solicitations; or submit automated or programmatic requests to our contact form or resource download endpoints.

We reserve the right to suspend or terminate your access to the Site at our sole discretion if you violate these Terms.

The Site includes interactive tools such as the R.O.T. Cost Calculator, Diagnostic questionnaire, and other assessment tools. These tools are provided for informational and educational purposes only.

No Guarantee of Accuracy. The outputs generated by these tools—including cost estimates, savings projections, R.O.T. percentages, and AI readiness indicators—are illustrative estimates based on industry benchmarks and the information you provide. They do not constitute professional advice, financial projections, guaranteed results, or a binding proposal for services.

Not Financial or Professional Advice. Calculator outputs should not be used as the basis for financial decisions, budget allocations, or business cases without independent verification. Actual results will vary based on your specific environment, data quality, organizational factors, and other variables.

Not a Substitute for Professional Engagement. Tool outputs are not a substitute for a formal diagnostic engagement or professional consultation. They are designed to provide a general indication of potential value and to inform initial conversations.

Data Handling. Information you input into interactive tools is processed in your browser to generate outputs. If you proceed to schedule a call from the calculator, your inputs are transmitted to our scheduling provider (Cal.com) as meeting notes. See our Privacy Policy for details.

Certain educational resources on the Site (such as the R.O.T. Framework Guide and AI Readiness Checklist) require you to provide your email address before downloading. By providing your email, you consent to us storing your email address and download record as described in our Privacy Policy. Downloaded resources are provided for your personal, non-commercial use and remain the intellectual property of Evil Genius MindWorks.

When you schedule a discovery call through our embedded Cal.com scheduling tool or submit our contact form, you agree to provide accurate and complete information. Scheduling a call or submitting an inquiry does not create a client relationship or constitute an agreement for services. Any engagement for professional services will be governed by a separate written agreement.

Discovery calls are complimentary consultations. We reserve the right to decline or reschedule calls at our discretion.

Our Content. All content on the Site—including but not limited to text, graphics, logos, trademarks (including Evil Genius MindWorks™, the CURE Methodology, R.O.T. Framework, and Cloud View Pro), images, illustrations, software, tools, downloadable resources, and blog content—is the property of Evil Genius MindWorks LLC or its licensors and is protected by United States and international intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any Site content without our prior written consent, except that you may download or print individual pages and permitted resources for your own non-commercial, informational use, provided you do not remove any copyright or proprietary notices.

Trademarks. Evil Genius MindWorks™, the Evil Genius logo, Cloud View Pro, the CURE Methodology, and the R.O.T. Framework are trademarks or service marks of Evil Genius MindWorks LLC. All other trademarks, service marks, and trade names appearing on the Site (including Qlik, QlikView, and Qlik Sense) are the property of their respective owners. Use of any trademarks without the owner’s express written permission is prohibited.

Your Submissions. If you submit information to us through the Site (such as contact form submissions, project details, or tool inputs), you grant us a non-exclusive, royalty-free right to use that information for the purposes of responding to your inquiry, preparing for consultations, providing services, and improving our tools and offerings. You represent that any information you submit is accurate and that you have the right to share it.

The Site includes a blog, downloadable resources (such as the R.O.T. Framework Guide, AI Readiness Checklist, Migration Playbook, Maturity Assessment, and KPI Mapping Guide), and case study content. This content is provided for general informational and educational purposes.

Not Professional Advice. Blog posts, guides, and resources do not constitute professional, legal, financial, or technical advice specific to your organization. Reliance on this content is at your own risk.

No Endorsement. References to third-party products, platforms, or organizations (including Qlik, and any client names referenced in case studies) are for informational purposes and do not imply endorsement by or affiliation with those entities, except where expressly stated (e.g., our Qlik Authorized Channel Partner status).

The Site contains links to and embeds from third-party websites and services, including Cal.com (scheduling), LinkedIn, and Qlik. These are provided for convenience and functionality. We do not control and are not responsible for the content, privacy practices, or availability of third-party websites and services. Your use of third-party services is subject to their respective terms and policies.

The Site and all content, tools, resources, and services provided through the Site are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Evil Genius MindWorks disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content, tool outputs, cost estimates, or information provided through the Site.

To the fullest extent permitted by applicable law, in no event shall Evil Genius MindWorks LLC, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to: your access to or use of (or inability to access or use) the Site; any content, tool outputs, cost estimates, or information obtained from the Site; any decisions made or actions taken in reliance on tool outputs or Site content; unauthorized access to or alteration of your data or transmissions; or any other matter related to the Site.

Our total aggregate liability for all claims arising out of or related to these Terms or your use of the Site shall not exceed one hundred dollars ($100.00).

You agree to indemnify, defend, and hold harmless Evil Genius MindWorks LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in the Commonwealth of Massachusetts, and you consent to the personal jurisdiction of such courts.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Evil Genius MindWorks with respect to your use of the Site. These Terms do not govern any professional services engagement, which will be subject to a separate written agreement.
